By accessing or using AstroSwami's services, including the AstroSwami WhatsApp chatbot and any related websites, content, features, or applications (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You represent that you are at least the age of majority in your jurisdiction and are legally competent to enter into these Terms. If you use the Services on behalf of an entity, you represent that you have authority to bind that entity, and "you" refers to the entity and its affiliates. AUCLAIR LIFESTYLE PRIVATE LIMITED retains the right to verify eligibility at any time.

2. Nature of the Service; No Professional Advice

AstroSwami, operated by AUCLAIR LIFESTYLE PRIVATE LIMITED, provides AI-generated astrology-related information and insights for informational and entertainment purposes only. The Services do not constitute professional advice (including but not limited to medical, legal, or financial advice). You are solely responsible for any decisions you make based on the information provided. AUCLAIR LIFESTYLE PRIVATE LIMITED disclaims all liability arising from reliance on the Services.

3. Accounts and Communications

Use of the Services may require a WhatsApp account and communication via WhatsApp. You are responsible for maintaining the security of your devices and accounts and for any activity occurring under your accounts. Standard messaging, data, and network rates may apply. AUCLAIR LIFESTYLE PRIVATE LIMITED is not responsible for WhatsApp-related issues outside the scope of the Services.

4. Acceptable Use

You agree not to: (a) misuse, interfere with, or disrupt the Services; (b) attempt to access non-public areas; (c) reverse engineer or copy the Services; (d) upload or transmit unlawful, infringing, defamatory, harassing, or harmful content; (e) use the Services to train competing models; (f) violate applicable laws or third-party rights. AUCLAIR LIFESTYLE PRIVATE LIMITED may suspend or terminate access for violations without notice.

5. User Content

You may submit text or other content through the Services ("User Content"). You grant AUCLAIR LIFESTYLE PRIVATE LIMITED and its affiliates a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use User Content as reasonably necessary to provide, maintain, protect, and improve the Services, comply with law, and develop new features, including for model safety and quality purposes subject to our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUCLAIR LIFESTYLE PRIVATE LIMITED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. AUCLAIR LIFESTYLE PRIVATE LIMITED DOES NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AUCLAIR LIFESTYLE PRIVATE LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. AUCLAIR LIFESTYLE PRIVATE LIMITED'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID TO AUCLAIR LIFESTYLE PRIVATE LIMITED FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless AUCLAIR LIFESTYLE PRIVATE LIMITED and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.
